The former manager of a takeaway with flats above has pleaded guilty to two offences under the Regulatory Reform (Fire Safety) Order 2005.
Mohammed Zafran Rashid of Caledonian Road, Dewsbury ran the premises – Sunrise Lodge in Batley – when his father was out of the country under a power of attorney. He was prosecuted under article 5(3) as a person who has control of the premises so far as requirements relate to matters within his control.
Kirklees Magistrates Court was told by West Yorkshire Fire and Rescue Service that the fire alarm appeared not to have worked for some time and a fire exit was blocked by a bed base and mattresses.
Mr Rashid was fined £1000 and ordered to pay £2570 costs.
